Terms of Use – Habits Hero

These Terms of Use ("Terms") govern your access to and use of the Habits Hero website, web application and iOS and Android mobile applications (together, the "Service"), operated by:

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Description of the Service

Habits Hero is an application designed to help users create, track and build habits, manage daily tasks and to-dos, track their progress and receive reminders or notifications.

Habits Hero offers a Free plan, a Premium plan and an Ultimate plan, as described in the application. Other plans or offers may be introduced in the future.

2. Eligibility and account

To use the Service, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

You must be legally able to enter into a binding contract to use the Service. If you are a minor, you may only use the Service with the consent of a legal representative, where required by applicable law.

3. Subscriptions, auto-renewal and billing

3.1. Plans

The Premium and Ultimate plans are auto-renewable subscriptions. The Premium plan gives access to all of Habits Hero's tracking features, notably including an unlimited number of habits, as well as to the AI companion described in Section 7, within the usage limits shown in the application. The Ultimate plan, a higher plan, includes the Premium plan and notably extends the AI companion's usage limits, memory and personalization. The duration and price of each subscription option (e.g. monthly, yearly) are displayed before purchase, in the application, on the corresponding App Store or Google Play product page or on the web purchase page.

3.2. Payment and renewal

Subscriptions are billed and managed by:

Apple App Store, for iOS;
Google Play, for Android; or
the RevenueCat Billing service, for purchases made from the web version.

Payment is charged to your Apple ID, your Google account or the payment method provided for a web purchase at confirmation of purchase. Unless cancelled at least 24 hours before the end of the current period, your subscription automatically renews for the same duration, and your account will be charged the renewal price then in effect through the same payment method, in accordance with the own terms of Apple, Google or the relevant payment provider. The status of your subscription is synchronized with your Habits Hero account through RevenueCat, our subscription management service.

3.3. Cancellation

You can manage or cancel your subscription at any time from your Apple ID account settings (iOS), your Google Play account settings (Android) or, for a web purchase, the subscription management link available in the application. Cancellation takes effect at the end of the then-current billing period; no partial refund is issued for the remaining period, except where required by applicable law or Apple's / Google's own refund policy.

3.4. Refunds

For purchases made through the App Store or Google Play, refund requests are handled directly by Apple (via reportaproblem.apple.com) or by Google Play, in accordance with their respective refund policies. Habits Hero does not process these refunds directly. For purchases made from the web version, refund requests must be sent to support@habits-hero.fr and are handled in accordance with applicable regulations.

3.5. Changes to pricing or plans

We may change subscription prices or the features included in each plan. Where required, you will be notified in advance through the App Store, Google Play or the application itself before any change applies to your then-current subscription.

4. User content

You remain responsible for the content you enter in the Service (habit names, descriptions, to-dos, messages sent to the companion, and any other free text). You agree not to enter unlawful content or content that infringes the rights of a third party.

You retain ownership of your content. You grant Habits Hero a limited license to host, store and process this content solely for the purpose of operating the Service, including, when you use the AI companion with your consent, sending it to our artificial intelligence provider to generate the companion's replies, as described in the Privacy Policy.

5. Acceptable use

You agree not to:

use the Service for any unlawful purpose;
attempt to gain unauthorized access to the Service or its underlying systems;
interfere with or disrupt the integrity or performance of the Service;
reverse engineer, decompile or extract source code from the application, except where permitted by law;
use automated means to access the Service without our authorization;
attempt to hijack, manipulate or bypass the rules of the AI companion (for example by trying to obtain its internal instructions), or use it as a general-purpose assistant outside its purpose;
enter unlawful content or content infringing the rights of a third party into the AI companion, notably third parties' personal data without their consent.

6. Intellectual property

The Service, including its name, logo, design, and underlying software, is the property of Habits Hero or its licensors and is protected by intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute or create derivative works based on the Service.

7. AI companion

7.1. Nature of the companion

The Service includes a companion (the mascot) that analyzes your habits, tasks, To-dos and mood to give you personalized tips, debriefs and reviews and, depending on your plan, to chat with you.

Free plan: the companion works from rules and pre-written texts, without generative artificial intelligence.
Premium and Ultimate plans: with your consent, the companion's messages are written by an artificial intelligence model and you can chat with it. You are then interacting with an AI system and not with a person; the content concerned is identified by an "AI" badge.

The Premium plan lets you choose the companion's tone. The Ultimate plan extends the usage limits, adds a memory of the information you share with the companion and allows full personalization (name, color, accessories).

The companion's use of AI is optional and subject to your consent. You can withdraw it at any time, or disable the companion entirely, from its settings. The data processed and the providers concerned, notably OpenAI, are described in our Privacy Policy.

7.3. AI-generated content

AI-generated content may be inaccurate, incomplete or unsuited to your situation. It is provided for information purposes only and in no way replaces the advice of a healthcare professional, a psychologist, a lawyer or any other professional. The companion does not make any diagnosis.

In case of distress or emergency, immediately contact the emergency services (112) or, in France, 3114 (suicide prevention).

The companion may suggest actions (for example changing the time of a reminder). A suggestion is only applied if you confirm it, and you remain solely responsible for your decisions.

7.4. Usage limits and availability

The AI companion is subject to usage limits depending on your plan (for example a maximum number of messages per day or per month, or a maximum length per message), shown in the application. They may change in accordance with Section 3.5.

The AI companion depends on the availability of our artificial intelligence provider. In case of unavailability, of a technical or budget limit being reached or of an invalid reply, the companion falls back to pre-written messages or tells you it is unavailable, without prejudice to your legal rights.

If your plan changes, the features your new plan does not include cease to be available: your personalization choices and memories are kept but are no longer used until your plan includes them again.

7.5. Proper use

You agree to use the companion in accordance with Section 5 and its purpose (habits, routines, well-being, productivity). We may limit or suspend your access to the AI companion in the event of abusive use.

8. Third-party services

The Service relies on third-party providers, notably Apple, Google, Google Firebase / Firebase Cloud Messaging, PostHog, RevenueCat (subscription management) and OpenAI (AI companion), as described in our Privacy Policy. Your use of these third-party services may also be subject to their own terms.

9. Termination

You may stop using the Service and delete your account at any time from the application settings or by contacting support@habits-hero.fr. Deleting your account does not automatically cancel an active App Store, Google Play or web subscription; you must cancel it separately as described in Section 3.3.

We may suspend or terminate your access to the Service if you breach these Terms, in particular Section 5 (Acceptable use), or if required to comply with applicable law.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free or available at all times. Habits Hero is a personal organization tool and does not constitute medical, psychological or professional advice.

The AI companion's content is generated by an artificial intelligence model and may contain errors; you should assess it with discernment, as set out in Section 7.3.

11. Limitation of liability

To the maximum extent permitted by applicable law, Habits Hero shall not be liable for any indirect, incidental or consequential damages arising from your use of, or inability to use, the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable French or European consumer law.

12. Changes to these Terms

We may update these Terms from time to time, notably to reflect new features, regulatory changes or new subscription plans. The last update date is shown at the top of this page. Where changes are significant, we may inform users through the application or by any other appropriate means. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by French law, without prejudice to any mandatory consumer protection provisions applicable in your country of residence. In the event of a dispute, and after an attempt to resolve it amicably, the competent French courts shall have jurisdiction, subject to any mandatory rules granting jurisdiction to the courts of your place of residence. Consumers may also refer to consumer mediation, in accordance with the French Consumer Code.
